The Food Safety & Standards Act. 2006 enacted by the legislature of India to improve the performance of the food industry. The primary purpose of the Act is to regulate the functioning of food operator, online seller, manufacturer, distributor, and importer. You can't start a food kind of business without a valid food license from concern state government. Therefore, any food manufacturing or food processing or packaging or distributing entity is now required to obtain a food license under FSSAI. The regulator has taken such active steps to introduce transparency in the food business and also to ensure that food products undergo certain quality checks, and food product should be prepared, packed and marketed as per pre-defined norms by FSSAI. Food License issued by FSSAI for carrying on activities related to food catering, restaurant, dried fruit packaging or processing or any stage of manufacturing, food processing, packaging, storage, transportation, and distribution of food in any form. All food units engaged in Food operating business (processing, packaging, manufacturing, re-labelling, Marketing, import and distribution or 100% Export unit) needs to get food License.
Business Exempt from Food License
Small retailer, Hawker, on wheel vendor or a temporary stallholder with permission of the appropriate authority, or small scale or cottage or such other industries relating to food cooking business operator are exempt from obtaining food License or FSSAI Registration.
Validity of Food License
After approval of the food License from FSSAI, generally, it is issued with a validity of one year or two years. Before expiry, if the license, it can be renewed for another one year or two years based on the requirements of the license holder.
Type Of License
Food license can be for state level operation or pan-India Operations.
Legally with state level license, you can operate a food business within a state. Small and medium Hotel, Restaurant, bar, outdoor food caters, medium size food manufacturers, Packers, small size Food processor is covered under State license. Large scale food producers, importer, and distributor, come under central licensing.
A separate food License/FSSAI License required and issued for each business location where food or type of food business. Therefore, an entity may have to obtain multiple food licenses if it operates various sites in a state of outside state. If you want to open five restaurants in one state and two outside states, then you need a food license for each location.

- FSSAI Registration --- Annual Turnover below Rs.12 lakhs-
- FSSAI State License --- Annual Turnover between Rs.12 Lac -20 crores.
- FSSAI Central License --- Annual Turnover above Rs.20 crores.
- FSSAI provides food license a 14-digit number provides information about the registration details.
- The Manufacturer shall display the FSSAI logo and its food license number on the label of the food package.
- The importer shall display FSSAI logo and Food license number along with the company name and address of importer on a sticker to be affixed before customs clearance in India.
